Terms & Conditions for Classes Packages:

Classes Packages are non-refundable & non-transferable to other participants.
Classes Packages are valid for 3 Months from Date of Purchase. Package validity extension is possible for up to a maximum of 3 additional months and involves an extension fee of 30 AED for every month.
Any class cancellations or class rescheduling must be done at least 4 hours prior to class starting time.
Not showing up to a booked class, rescheduling or cancelling a class less than 4 hour prior to class time will result in the class being deducted from the classes package or from the make-up classes based on the enrollment package of the student.
It is mandatory for all members and students to book online via the online booking platform to be allowed access to any class. Pinpoint Fitness LLC reserves the right to deny access to any member or student showing up to class without having prior booking.
Only registered students are allowed access to the training facility. Parents, guardians and non-participants and are not allowed to enter the gym floor or training area (excluding the Toddlers Classes for participants below the age of 4 years old).
Pinpoint Fitness LLC reserves the right to dismiss any participants from its training centers if they violate the terms and conditions of the class packages or engage in any misconduct towards any staff member without any refunds.
Parents (or guardians appointed by parents) are responsible for picking up the participating children from the premises of the training area immediately after the conclusion of the attended session. Pinpoint Fitness LLC bears no responsibility for the supervision of any child after the conclusion of their scheduled session.

Rules, Terms & Conditions of Toddlers Classes (for participants below the age of 4 years):

Parents must accompany their children at all times while in the class and inside the facility. In case a guardian is accompanying the child, the guardian must accompany the child at all times and abide by all the rules and terms & conditions mentioned here.
Each child must be accompanied by one parent. In case of siblings or twins, each sibling must be accompanied by a parent or guardian appointed by the parent.
The parent (or guardian) must accompany and guide their own child throughout the class and during the entire time they are inside the facility and never leave the child unattended to ensure their safety.
Parent (or guardian) & child must both remain inside the designated area of the Toddlers Class throughout the duration of class (45 minutes). Parent (or guardian) must refrain from using any equipment outside the designated area by themselves or by their child.
The assigned coach will give instructions to the parents & guardians of the children on what the child is expected to do at each station. The coach may also spend individualized time with each participant when needed to learn a new move or master a skill at one station.
Coaching effort and time will be distributed evenly among the participants. However, while the coach is engaged with one participant, all parents or guardians of other children are expected to continue implement the instructions given by the coach for their child (without leaving them unattended).
No foods or drinks are allowed inside the training area. Drinking water bottles must be closed.

Health & Fitness Liability Waiver /Informed Consent Form, Assumption of Risk and Release of Liability:

I, the participant or parent specified below, have enrolled myself (or my child) in the personalized health and fitness program offered by Pinpoint Fitness LLC. I confirm that I am the legal parent or guardian of the minor child (if applicable), and I have full legal authority to enter into this agreement on their behalf.

I recognize that the program may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities. I hereby affirm that I am (or my child who I enrolled is) in good physical condition and do not suffer from any known disability or condition which would prevent or limit the participation in this exercise program. I, the participant (or parent who enrolled my child), specified below acknowledge that my enrolment and subsequent participation (for myself or my child) is purely voluntary and in no way mandated by Pinpoint Fitness LLC. I am not obligated to perform nor participate in any activity that I do not wish to do (or have my child do), and that it is my right to refuse such participation at any time during the training session. I understand that should I feel light-headed, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity. I, the participant (or parent who enrolled my child) specified below, am aware that there are significant risks involved in all aspects of athletic activities and physical training. These risks include, but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains. I am aware that any of these above mentioned risks may result in serious injury or death to myself (or my child who I enrolled) and or my partner(s) in training. In consideration of my participation in this program (for myself or my child), I hereby release Pinpoint Fitness LLC and its principals, agents, employees, trainers, contractors, outsourced service providers and volunteers from any claims, demands, and causes of action as a result of my voluntary participation and enrollment (for myself or my enrolled child). I, the participant specified below, fully understand that I may injure myself (or my child who I enrolled may injure themselves) as a result of this enrolment and subsequent participation in this program and I hereby release Pinpoint Fitness LLC and its agents from any liability now or in the future for conditions or injuries that I (or my enrolled child) may obtain. These conditions and injuries may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, trauma, anxiety, fears, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness that I (or my enrolled child) may incur, including death.

Emergency Medical Services:

I, the participant or parent specified below, give permission for Pinpoint Fitness LLC staff and trainers to seek emergency medical services for me should I become injured or ill, with the understanding that I am responsible for any expense incurred. If I am signing on behalf of a minor child, I also give full permission for any person connected with Pinpoint Fitness LLC to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the wellbeing of the child if deemed necessary.

Medical Insurance Disclaimer:

I understand and agree that Pinpoint Fitness does not provide any personal accident, health, or medical insurance coverage for injuries, illnesses, or accidents that may occur as a result of participation in training activities. It is my sole responsibility to obtain and maintain such insurance coverage for myself or my enrolled child if desired.

Indemnity:

I, the participant or parent specified below, accept financial responsibility for any injury that may happen to myself (or my enrolled child) while participating in activities offered by Pinpoint Fitness LLC. I also accept financial responsibility for any injury to any other participants due to my negligence. I further agree to indemnify and hold harmless Pinpoint Fitness LLC, their principals, agents, employees, trainers, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Pinpoint Fitness LLC. This includes but is not limited to Pinpoint Fitness LLC gym facility, parks, recreational areas, playgrounds, areas adjacent and/or any area selected for training by Pinpoint Fitness LLC.

Photograph or video:

I, the participant specified below, acknowledge that I (or my enrolled child) may be photographed or videotaped during training. I hereby consent to the use of these photographs and/or videos without compensation, on the Pinpoint Fitness LLC website or in any editorial, promotional or advertising material produced and/or published by Pinpoint Fitness LLC.

Governing Law and Jurisdiction:

This agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute or claim arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the Courts of Dubai.

Language Acknowledgment:

I confirm that I have read and understood this agreement in full. If necessary, I was provided with a translation or verbal explanation in a language I understand. I agree that I am signing this agreement voluntarily and with full understanding of its contents and implications.

Important Note:

I am aware that this agreement is ongoing and will apply to all future occasions I (or my enrolled child) participate in athletic activities and training with or at the direction of Pinpoint Fitness LLC. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. I have read and understand the above statements. I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission.
